Introduction

  Obtaining tourist (L) or business visa (F) to visit China is a fairly simple process. Not so for Occupational Visa (a/k/a Work Visa, Z visa). The regulatory regime of work visa consists of the Labor and Immigration authorities, both of which exercise a great deal of discretion under the broad legal mandate.

  Generally speaking, application for work visa must be initiated by a Chinese employer, which should first have License to Employ Foreigners unless qualifying for exemption. Foreign nationals must apply for Work Permits after arrival in China. Work Permit is employer-specific and only valid within the jurisdiction of the issuing labor administration. Foreign nationals employed in China must enter into employment contracts with their employers, which shall have a term not exceeding five years.

  Depending on job positions and/or business forms of the Chinese employers, different labor documents are required. While foreign nationals may enter into China with Work Visa obtained from Chinese Consulates overseas, they are generally allowed to covert their status to Work Visa Status after their arrivals in China. Regardless the entry visa type, foreign nationals employed in China must pass a medical examination (physical) and obtain a Residency Permit from the local police station of their residence.
